If the guitar plays fine I'd be OK with it.
You could take a little off the top if it bothers you.

I don’t know if it’s the nut or the frets but I get a lot of string slap on the high e when I dig in. It’s possible it could be technique (way possible) but on the other hand it’s not happening on my factory made Alvarez that I got for about a third of the price. It’s too bad because the neck is about the perfect amount of chunk whereas the Alvarez doesn’t support my palm nearly as well.
It’s also going out of tune fairly easily. The reverb seller is local to me and gave me a two day grace period to return it. I’m leaning heavily towards that option. A setup could work some wonders but I’m inclined to move on.
Pluses-really like the neck, nice nasal honk I presume is from the cherry back and sides.
Minuses-several besides the ones I mentioned.

When you first posted, I didn't see the pic from the bass side (oblique) - unless you are depressing the strings while holding it for the picture, the action appears to be quite low at the nut.

Hold down at the 3rd fret and see how much clearance there is on each string at the 1st fret - should be just enough to slide a piece of paper under.

Also, it looks like the b string is cut a little closer to the g than the e.

Yeah, this is the only thing I noticed also.
