(b) A person authorized to conduct a raffle under this section must be a member of a licensed authorized organization as provided by Section 2001.411.

SUBCHAPTER B. OPERATION OF RAFFLE
§ 2002.051. Raffle Authorized
A qualified organization may conduct a raffle subject to the conditions imposed by this subchapter.
Don't look good for a raffle unless you go non-profit

Just food for thought, but how about a "Closed Raffe"? In other words, sell a predetermined number of tickets, for example 200 of them for say $50.00 each. This would narrow the chances of winning tremendously, and if you wanted to buy 2 tickets, you could narrow it even more. This would also enable you to "keep it in the family" so to speak, as the only way to buy the tickets would be through the TGF.

I don't know the legal ins and outs of this, but thought I'd throw in my $.02!

Caveat: I am a CPA and NOT an attorney.

From a tax side, there are a few hurdles to get over in qualifiying for 501(c) status but the real issues here are from the legal side. Even if the forum was able or already has tax-exempt status under IRC Section 501(c)(7), many states prohibit games of chance. Plexipers referenced Texas statutes but the other concern is that other states may have jurisdiction based on the fact that a member purchasing a raffle ticket lives there (i.e. if the state of New York prohibits raffles for tax-exempts then those members living in NY could not participate). So even if we were able to meet the raffle requirements of the state of Texas, there still could be issues with other states.

I would be interested to see if any attorneys (or others of course) on the TGF think there are any exceptions based on the fact the raffle would be restricted to members only and not open to the general public. Since there are low barriers in joining the TGF, I don't think this would help but it might be worth a try.

At first glance, a raffle may be more trouble than it's worth and we need to keep J.R. out of the big house.

Just reading through some of the information that Plexiprs posted.... YIKES!!! I need a lawyer AND a CPA on retainer to run a non-profit. I don't even meet requirement #1 for a non-profit.

Looks like an auction, boys and girls.

Plexiprs, thanks for posting that info. Vito is right. To open this up to multiple states, it looks like I would have to meet their requirements as well as the stiff requirements in Texas. And there's no way I can do that. First requirement is legal non-profit status. Second requirement is that the non-profit has to have been established for over three years.
